These Terms of Service (“Terms”) govern your use of seviracosmetics.com (the “Site”) and any purchase you make from Sevira. By accessing the Site or placing an order, you agree to these Terms. Please read them carefully. Nothing in these Terms excludes, restricts or modifies any rights you have under the Australian Consumer Law.

Eligibility

You must be at least 18 years old to purchase from us. By placing an order you confirm that you are 18 or over and that the information you provide is accurate and complete.

Products, pricing and availability

All prices are listed in Australian dollars (AUD) and, where applicable, include GST. We try to display products and colours as accurately as possible, but actual appearance may vary depending on your screen. We may change prices, descriptions and product availability at any time without notice. Products are subject to availability, and we may limit quantities or decline an order.

Orders and acceptance

Your order is an offer to purchase. We accept your order when we send you a confirmation. We reserve the right to refuse or cancel any order, including where there is a pricing or product error, suspected fraud, or stock is unavailable. If we cancel an order you have paid for, we will refund you in full.

Payment

Payment is required at the time of purchase through our available payment methods. By submitting payment details you confirm you are authorised to use the chosen payment method.

Shipping and returns

Delivery is handled in accordance with our Shipping Policy, and returns and refunds are handled in accordance with our Refund & Returns Policy. Both policies form part of these Terms.

Product information and use

Our cosmetic and skincare products are intended for external cosmetic use only and are not therapeutic goods. They are not intended to diagnose, treat, cure or prevent any disease or medical condition. We recommend reviewing the ingredient list and carrying out a patch test before use. If you have a known allergy or sensitivity, or you are pregnant or have a medical condition, please consult a qualified professional before use. Individual experiences may vary.

Intellectual property

All content on the Site, including the Sevira name and logo, text, images and design, is owned by us or our licensors and is protected by law. You may not copy, reproduce or use it without our written permission.

Acceptable use

You agree not to use the Site for any unlawful purpose, to interfere with its operation or security, or to attempt to gain unauthorised access to our systems or data.

Third-party links

The Site may contain links to third-party websites. We are not responsible for the content or privacy practices of those sites.

Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental or consequential loss arising from your use of the Site or our products. Where mandatory consumer law applies, such as the Australian Consumer Law or consumer law in the EU and the UK, the consumer guarantees it provides cannot be excluded, and where our liability can be limited rather than excluded, our liability is limited, at our option, to resupplying the goods or paying the cost of resupplying the goods.

Governing law and your consumer rights

These Terms are governed by the laws of the Netherlands. This choice of law does not deprive you of the mandatory consumer protection rights you have in your country of residence. For example, customers in Australia keep their rights under the Australian Consumer Law, and customers in the EU and the UK keep their statutory consumer rights. Nothing in these Terms excludes, restricts or modifies any right that applicable law says cannot be excluded.
